These Terms of Service (“Terms”) govern your access to and use of Bebriz (the “Service”), operated by Bebriz, located at 3832 Brockenhurst Dr., Buford, GA 30519, United States (“we”, “us”, “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Bebriz is an AI-powered tool that helps Etsy sellers generate optimized product photos, SEO titles, tags, and listing descriptions from a reference photo. The Service is not affiliated with, endorsed by, or sponsored by Etsy, Inc. Etsy is a trademark of Etsy, Inc.
2. Eligibility & Accounts
You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized access.
3. Plans, Billing, and Refunds
- Free plan: includes a monthly quota of generations. Quotas reset at the start of each calendar month.
- Paid plans: billed monthly or annually in advance through Stripe. Subscriptions auto-renew until cancelled. Cancellations take effect at the end of the current billing period.
- Refunds: we offer a 30-day money-back guarantee on the first paid month. Contact support@bebriz.com to request a refund.
- Free trial: paid plans include a 7-day free trial; you will be charged at the end of the trial unless you cancel.
4. Your Content
You retain all rights to the photos and information you upload (“Your Content”). You grant us a limited, worldwide, royalty-free license to store, process, and transmit Your Content solely to provide the Service to you — including sending images to our AI model providers for generation.
You represent and warrant that you have the right to upload Your Content and that it does not infringe third-party rights. Do not upload content depicting minors, sexually explicit material, hate speech, violent imagery, or anything illegal.
5. AI-Generated Output
Output produced by the Service (photos, titles, tags, descriptions) is provided as-is. Because the underlying AI models are probabilistic, output may occasionally be inaccurate, misleading, or unsuitable. You are responsible for reviewing all output before using it in your Etsy listings. AI-generated photos may not perfectly preserve every product detail; verify accuracy before publishing.
Subject to your compliance with these Terms, we grant you a worldwide, royalty-free license to use the AI output for your commercial Etsy listings and related marketing. We claim no ownership over the generated output.
6. Acceptable Use
You agree not to:
- Reverse engineer, scrape, or systematically extract the Service;
- Use the Service to generate misleading, deceptive, or illegal content;
- Resell or sublicense the Service without our prior written permission;
- Use automated means to exceed your generation quota or otherwise abuse the Service;
- Upload malware, attempt to gain unauthorized access, or interfere with other users.
7. Intellectual Property
The Service, including its design, code, brand, and documentation, is owned by Bebriz and protected by intellectual property laws. Nothing in these Terms transfers our IP to you.
8. Third-Party Services
The Service relies on third-party providers including Supabase (authentication, database, storage), Stripe (payments), and OpenAI (AI models). Your use of those providers’ services through Bebriz is also subject to their respective terms.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE PARTICULAR RESULTS (INCLUDING ETSY RANKING OR SALES).
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEBRIZ AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless Bebriz from any claims, damages, or expenses arising out of Your Content, your use of the Service, or your violation of these Terms.
12. Termination
You may cancel your subscription at any time from the billing portal. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ends; we may retain your data for a reasonable period for backups, legal compliance, and dispute resolution.
13. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will notify you by email or in-product. Continued use of the Service after the effective date constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Gwinnett County, Georgia, and you consent to that jurisdiction and venue.
